The administration of King George’s Medical University (KGMU), Lucknow, has put up a notice on the shrine, which is being seen as an attempt to ease pressure from the doctor conversion case. This action appears to be under political pressure and is constitutionally inconsistent.Historical and Legal Status of the ShrineThis shrine has existed since before KGMU was built and falls under the Uttar Pradesh Sunni Central Waqf Board. Under Sections 3 and 32 of the Waqf Act, 1995, the protection of waqf property is ensured.The Board appoints a mutawalli, who submits an annual audit report of income and expenses.Both—KGMU and the Waqf Board—are under government control, so issuing a notice labeling the shrine as ‘unauthorized’ is administrative high-handedness by KGMC. This violates Article 25 (religious freedom) and Article 26 (management of religious institutions) of the Indian Constitution.Unconstitutionality of the NoticePosting a notice like ‘discharging’ the shrine is absurd and illegal—it’s not a hospital patient. If there was actual encroachment, orders from the High Court or Supreme Court would be required, as in the case of Lucknow’s Haji Harman Dargah. There, the court refused permission to remove it and ensured its protection.Why did KGMU ignore other religious sites (operated by faith)? This discriminatory action is a clear violation of Article 14 (right to equality).Hint of Political ConspiracyAfter the doctor conversion controversy, this notice seems like an attempt to target a religious site of a specific community. Taking action without prior notice and hearing to the Waqf Board is illegal (against the principles of natural justice). If KGMU needs the land, it should follow legal procedures, not ‘get rid’ via a notice. This matter can be challenged in the Waqf Tribunal or High Court.
